Barking & Dagenham considers legal action over power supply failure

McClaren Construction failed to meet compliance requirements at a major development.

An £85 million mixed -use development at 12 Thames Road in the London borough of Barking & Dagenham, commissioned through the council’s Be First regeneration arm, was completed by the contractor in 2024. This included 17 industrial units, a 5,000 square metre commercial space and 156 homes.

However, the authority says it is now pursuing legal action against the firm for failing to comply with British Standard due to the absence of a secondary power supply. The company denies this.

‘The position regarding 12 Thames Road remains a live contractual and legal matter,’ a spokesperson for the authority told Construction News. ‘The council and Be First are pursuing appropriate contractual and legal options in relation to the contractor responsible for the works, including potential recovery of costs. While full recovery of costs is not guaranteed, we are using every legal avenue available to pursue repayment.’
